1. Scope and Agreement

These Terms and Conditions apply to all purchases made by consumers on the TinySeats website within Sweden and the European Union. By placing an order, you agree to be bound by these terms, as well as our Privacy Policy, Shipping Policy, and Returns & Refund Policy.

2. Ordering and Contract

  • Binding Agreement: A binding purchase agreement is only formed once we have sent an order confirmation to your provided email address.

  • Accuracy: You are responsible for ensuring all provided customer information (name, address, email) is accurate.

  • Right to Decline: We reserve the right to cancel or decline any order (e.g., due to incorrect pricing, stock errors, or suspected fraud).

3. Pricing and Payment

  • VAT: All prices displayed for EU customers include Swedish VAT (moms) unless otherwise stated.

  • Currency: Transactions are processed in SEK / EUR, or any such currency as indicated during check-out.

  • Payment Methods: We use secure third-party payment providers (e.g., Shopify Payments, Klarna, Shop Pay). By paying, you also agree to the terms of these providers.

  • Errors: In the event of an obvious pricing error, we reserve the right to cancel the order and provide a full refund.

4. Shipping and Delivery

Our delivery times and costs are detailed in our Shipping Policy.

  • Risk of Loss: The risk for the goods passes to you upon delivery.

  • Unclaimed Packages: If a package is returned to us because it was not collected or the delivery was refused, we reserve the right to charge a fee to cover return shipping and administrative costs.

5. Right of Withdrawal and Returns

Your right to cancel your purchase and return goods is governed by the Swedish Distance Contracts Act (Distansavtalslagen) and the EU Consumer Rights Directive. Detailed instructions and safety-related restrictions are found in our Returns & Refund Policy.

6. Warranty and Complaints (Reklamationsrätt)

  • Legal Guarantee: In accordance with EU law and the Swedish Consumer Sales Act (Konsumentköplagen), you have a right to complain about faulty products.

  • Process: Any defects must be reported within a reasonable time (2 months is always considered reasonable) after the defect was discovered. Please refer to our Returns Policy for the "Faulty Items" process.

  • Limitations: The warranty does not cover defects caused by normal wear and tear, incorrect installation (contrary to the manual), or misuse.

7. Product Safety and Liability

  • Safety Standards: TinySeats products are certified to European safety standards (UN ECE R129/i-Size).

  • Installation: Correct installation is the user's responsibility. TinySeats Europe AB is not liable for damages or injuries resulting from improper installation or use of the product.

  • Manuals: You agree to read and follow the provided user manual and safety instructions before use.

8. Intellectual Property

All content on this website, including logos, designs, text, and images, is the property of TinySeats Europe AB or its licensors and is protected by copyright laws.

9. Force Majeure

TinySeats Europe AB is not liable for delays or failures caused by circumstances beyond our control, such as labor disputes, fire, war, government action, or transport disruptions.

10. Governing Law and Disputes

  • Law: These terms are governed by the laws of Sweden.

  • Dispute Resolution: If a dispute cannot be settled between us, you can contact the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden - ARN) at www.arn.se.

  • EU ODR: You may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
